TERMS AND CONDITIONS OF AFFILIATE PROGRAM

These terms and conditions (The “Terms and Conditions”) govern the use of displayarama.com (the “Site”) and our affiliate program. This Site is owned and operated by Displayarama Enterprises LLC. This site is an e-commerce website.

By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

1. Introduction – Welcome to the DISPLAYRAMA Affiliate Program! By joining our program, you agree to abide by these Terms and Conditions (the “Agreement”). This Agreement outlines the terms under which you may participate in our Affiliate Program.

2. Enrollment – To enroll in the affiliate program, you must submit a complete application through our platform. Your participation is subject to approval at our sole discretion.

3. Compliance with Laws – As an affiliate, you must comply with all federal, state, and local laws including but not limited to email marketing laws such as the CAN-SPAM Act.

4. Promotion of Our Relationship – a) You are permitted to use the marketing materials provided by us. b) All affiliates are prohibited from creating websites or advertisements that falsely represent themselves as DISPLAYARAMA or Displayarama Enterprises LLC. c) Spamming is strictly forbidden. d) Affiliates must not use methods deemed inappropriate or fraudulent.

5. Commission Rates & Payments –  a) Commissions will be paid on net sales (excluding returns and cancellations, shipping and sales tax) for new customers to Displayarama Enterprises LLC. b) The commission rate may be determined based on product/service sold. c) Payments will be made via Paypal, on a quarterly basis for commissions earned in the previous quarter. d) A minimum balance of $10 must be met before payment will be issued. e) A grace period for resolving returns is 60 days so commissions will not qualify for payout until after this 60 day grace period. f) Once a customer is a referral, their purchases will qualify as commissionable for 12 months from first visit to site.

6. Intellectual Property Rights – All trademarks, service marks, logos owned by us remain our property; affiliates receive no right or license except for purposes expressly outlined herein.

7. Tracking Sales – We will provide tracking tools within your affiliate dashboard; however we cannot guarantee 100% accuracy due to various technical reasons outside of control like browser settings etc that might affect tracking cookies performance.

8. Referral Cookie Life – The referral cookie life is set at 90 days. If a referred customer purchases after this period it won’t qualify for earning commission.

9. Termination – This agreement may be terminated by either party at any given time, provided that a notice is duly sent to the other party. Additionally, participation in this program can be immediately terminated without prior notice if it’s determined that there has been a violation of the Terms and Conditions outlined in this document.

10. Limitation of Liability – Under no circumstances shall either party be held liable for any indirect, incidental, or consequential damages arising from their affiliation as stipulated under this agreement. The maximum liability will not exceed the total commissions paid to the affiliate during the three months prior to when the claim was made.

11. Modifications To Agreement – We reserve the right to modify any part of this agreement or introduce new guidelines at any time, provided that we give advance written notice to current members. It is expected that members review these modifications and their acceptance is considered a condition for continued participation in the program after the changes take effect.

12. Miscellaneous Provisions – These terms and conditions represent the complete agreement between the parties regarding the subject matter herein and supersedes all previous agreements, representations, and understandings.

13. Governing Law – The process of dispute resolution under this agreement shall be governed by the laws and regulations of the jurisdiction in which Displayarama Enterprises LLC is headquartered. Any disputes arising from contractual obligations or failures to resolve such disputes will be subject to mediation or arbitration, with the location for these proceedings being determined by Displayarama Enterprises LLC.

By applying and participating, you affirm that you have read, understood, and agree to be bound by the conditions stated above. Failure to adhere to these terms may result in consequences including but not limited to expulsion from the program and forfeiture of any accumulated earnings.
